Overview
Welcome to Soumyata. In these Terms, "we", "us" and "our" refer to Vedika Handloom, a sole proprietorship of Sonam Pandey, which owns and operates the Soumyata brand and this website, together with all related content, features, tools, products and services (the "Services").
Our website is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with the policies referred to in them (our Refund Policy, Shipping Policy and Privacy Policy), describe your rights and responsibilities when you use the Services. Please read them carefully — they include important information about your legal rights, including disclaimers and limits on our liability.
By visiting or using the Services, you agree to be bound by these Terms and by our Privacy Policy [LINK]. If you do not agree, please do not use the Services.

All goods sold through the Services are manufactured in India.
2. Eligibility and your account
By using the Services you confirm that you are at least 18 years of age and competent to contract under the Indian Contract Act, 1872. If you permit a minor in your care to use the Services on a device you own or manage, you accept responsibility for that use.
To place an order you may be asked for information such as your name, email address, delivery address, phone number and payment details. You confirm that the information you give us is true, current and complete, and that you are entitled to provide it.
Creating an account is optional — you may check out as a guest. If you do create an account, you are responsible for keeping your login secure and for activity that takes place through it. You may not transfer, sell or assign your account to anyone else.
3. Our products
Every piece we sell is handmade. We photograph and describe each one as accurately as we can, but you should be aware of two things before ordering.
Colours vary between screens. How a colour appears depends on your device, its settings and the light you are viewing it in. We colour-correct our photographs as truthfully as we can, but we cannot guarantee that a shade on your screen will match the cloth exactly.
Handloom cloth is not uniform, and is not meant to be. Slubs and uneven thickness in hand-spun yarn, small irregularities in weave, border alignment or selvedge, and the non-identical repeats that are characteristic of hand painting are inherent features of the work, not defects. Our Refund Policy sets out in detail what we treat as a defect and what we do not.
Product descriptions, availability and prices may change at any time without notice. We may discontinue any product, and may limit the quantity of any product we sell to any person or region.
4. Orders
When you place an order you are making an offer to purchase. We may accept or decline any order at our discretion. Your order is accepted only when we confirm it, and we must have received your payment before acceptance.
Almost every piece we sell exists in a quantity of one. If a piece becomes unavailable between your order and our acceptance, we will tell you and refund you in full.
Please check your order carefully before submitting it. You may cancel free of charge at any time before the order is dispatched. Once it has been handed to the courier, our Refund Policy applies instead.
If we decline, change or cancel an order, we will try to reach you using the email address or phone number you gave us.
Our products are sold for your own personal or household use, and not for commercial resale.
5. Prices, GST and payment
All prices displayed on our website are in Indian Rupees and are inclusive of GST at the applicable rate. Shipping charges, where they apply, are shown separately at checkout before you pay.
The price charged is the price shown at the time you place the order, and it will be set out in your order confirmation. Prices, discounts and promotions may change at any time without notice, and prices shown here may differ from prices offered elsewhere.
Where we run a promotion governed by its own terms, and those terms conflict with these Terms, the promotion terms will apply to that promotion.
You confirm that any payment instrument you use is one you are authorised to use, and that you will pay the amounts shown at checkout.
For international orders, any customs duties, import taxes or charges levied in the destination country are payable by you and are not included in our prices.
6. Shipping and delivery
We dispatch through third-party courier partners. Delivery timelines shown on our website are estimates, and we cannot guarantee them. We are not responsible for delays caused by couriers, weather, customs processing or other events outside our control.
We remain responsible for your order until it is delivered to you. If a piece is lost or damaged in transit, tell us and we will replace or refund it in accordance with our Refund Policy — you do not bear that risk.
Please give a complete and correct delivery address. Where a shipment fails because the address was incorrect or nobody was available to receive it after repeated attempts, any re-dispatch cost may be payable by you.

7. Returns and refunds
Returns, refunds and cancellations are governed by our Refund Policy , which forms part of these Terms. In summary: 7 days to report a damaged, defective or incorrect item at our cost, and 3 days to return an unused piece if you have simply changed your mind.
8. Intellectual property
The Services — including our brand name, logo, photographs, product descriptions, text, graphics, video and the selection and arrangement of them — are owned by Vedika Handloom or its licensors and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable Indian and international intellectual property laws.
You may use the Services for your own personal, non-commercial purposes only. You may not copy, reproduce, republish, distribute, modify, create derivative works from, publicly display or transmit any material from the Services without our prior written permission. This applies particularly to our product photographs, which are original works we have paid to produce.
"Soumyata" and "Vedika Handloom", together with our logos and product names, are our trade marks. You may not use them without our written permission. Shopify's name and logo are trade marks of Shopify. All other marks appearing on the Services belong to their respective owners.
All rights not expressly granted are reserved.
9. Reviews, photographs and feedback
If you send us or post a review, photograph, suggestion, comment or other content ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display it in connection with our business, including in marketing. You can ask us to stop using your Feedback at any time by writing to us, and we will do so within a reasonable period.
You confirm that any Feedback you send is your own, that you have the right to send it, and that it does not infringe anyone's copyright, trade mark, privacy or other rights. You must not submit content that is unlawful, defamatory, obscene, abusive or misleading, impersonate anyone, or use a false email address.
We are not obliged to keep Feedback confidential, to pay for it, or to respond to it. We may remove any Feedback we consider unlawful or objectionable, but we have no obligation to monitor it and we are not responsible for Feedback posted by others.
10. Third-party links and tools
The Services may link to, or embed functionality from, websites and tools operated by third parties. We do not control these and are not responsible for their content, accuracy, products or practices.
Any third-party tools are made available "as is", without warranty or endorsement from us, and your use of them is at your own risk. Please read the relevant third party's own terms and policies before using them. Questions or complaints about a third party's products or services should be directed to that third party.
11. Errors and inaccuracies
Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, shipping charges, delivery times or availability.
We may correct any such error and may change or update information, or cancel an order placed on the basis of inaccurate information, at any time and without prior notice — including after you have placed the order. Where we cancel an order for this reason, we will refund you in full.
12. Relationship with Shopify
Soumyata is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Vedika Handloom. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Vedika Handloom, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Vedika Handloom.
13. Privacy
Personal information we collect through the Services is handled in accordance with our Privacy Policy [LINK]. Because the Services are hosted by Shopify, some information is also processed by Shopify under Shopify's privacy policy, and may be transmitted to and stored in countries other than the one you live in.
By using the Services, you confirm that you have read these policies.
14. Prohibited uses
You may use the Services for lawful purposes only. You must not:
- use the Services for any unlawful, fraudulent or malicious purpose, or in breach of any applicable law
- infringe our intellectual property rights or those of anyone else
- harass, abuse, threaten, defame or harm any person
- transmit false or misleading information, or impersonate another person
- send spam, chain messages or unsolicited promotional material
- upload viruses or other malicious code
- copy, extract, resell or exploit any part of the Services, including our product photographs and descriptions
- collect or track the personal information of others
- use any robot, spider, scraper, automated data-gathering tool or automated agent to access the Services, or conceal that access is automated
- interfere with, bypass or circumvent our security measures, robot exclusion headers or any other measure we use to restrict access
We may suspend or terminate your access at any time if we consider that you have breached this section.
15. Disclaimer of warranties
We provide the Services on an "as is" and "as available" basis. We do not guarantee that the Services will be uninterrupted, timely, secure or error-free, or that information on them is complete or free of error. Any reliance you place on general information on the Services is at your own risk.
Nothing in this section affects your statutory rights as a consumer under the Consumer Protection Act, 2019 or any other applicable law, including your right to goods that match their description and are of satisfactory quality.
16. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, savings, data or goodwill, arising out of your use of the Services or of any product bought through them.
Where we are liable, our total liability in connection with any order is limited to the amount you paid for that order.
These limits do not apply, and nothing in these Terms excludes or restricts our liability, in respect of: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; defective goods; deficiency in service; or any other liability that cannot lawfully be excluded, including your rights under the Consumer Protection Act, 2019.
17. Indemnity
You agree to indemnify and hold harmless Vedika Handloom, Shopify and our respective officers, employees, agents and service providers against any loss, damage, liability or claim, including reasonable legal costs, arising from your breach of these Terms, your violation of any law or third-party right, or your misuse of the Services.
We will notify you of any such claim and may control its defence at your cost, but will not settle a claim that imposes a non-monetary obligation on you without your consent, which you will not unreasonably withhold.
18. Termination
We may suspend or terminate your access to the Services at our discretion and without notice. You will remain liable for any amounts owed up to the date of termination.
The following sections survive termination: Intellectual Property; Reviews, Photographs and Feedback; Disclaimer of Warranties; Limitation of Liability; Indemnity; Governing Law; Grievance Redressal; and any other provision which by its nature should survive.
19. Governing law and jurisdiction
These Terms and any dispute arising out of them or out of your use of the Services are governed by the laws of India. Subject to your rights under the Consumer Protection Act, 2019 — which allow you to approach a consumer commission where you reside or work — the courts at Bhagalpur, Bihar shall have exclusive jurisdiction.

We acknowledge complaints within 48 hours and aim to resolve them within one month, in line with the Consumer Protection (E-Commerce) Rules, 2020.
21. General
Severability. If any provision of these Terms is found unlawful or unenforceable, it will be enforced to the greatest extent permitted and severed to the extent it cannot be; the remaining provisions continue in force.
Waiver. If we do not enforce a right or provision, that is not a waiver of it.
Entire agreement. These Terms, together with the policies referred to in them, form the whole agreement between you and us regarding the Services and supersede any earlier agreements or understandings.
Assignment. You may not assign or transfer your rights under these Terms without our written consent. We may assign ours without notice.
Headings are for convenience only and do not affect interpretation.

The current version of these Terms is always available on this page. We may update them at any time by posting the revised version here. Where a change is material, we will notify you as required by applicable law. Continuing to use the Services after a change takes effect means you accept it.
